You do have a fair point about the legs and supercilium. But there is considerable variation of those features among Smoky Warblers. Just go through the images on OBI (link above). Legs can appear brown because of mud.

I think it could be a Dusky Warbler which has been claimed for the Delhi area but never conclusively proven.
